As negligent hiring, retention, and defamation lawsuits increase,
recruitment and training costs spiral upwards, and workplace
violence and theft cases abound, employers realize the need
to know as much as possible about each employee. Surveys report
30 - 50% of applicants lie or exaggerate on applications and
more than 5% of applicants have criminal records. The need
to investigate and verify applicant history is more important
than ever.
However, federal and state laws regulate the information
that employers may obtain in an effort to balance employers
rights with employees privacy. Employers conducting background
investigations must be fully aware of the various laws and
the specific requirements placed on the employer.
